Altium is using clearance rule instead of creepage rule over an air gap

The clearance rule is 4.1mm and the creepage rules is 3.1mm but the clearance rule is still overwriting the creepage,

Clearance is the distance through the air.
Creepage is the distance over a surface (not only the PCB!)
So picture (Altium) seem correct.

Often the creepage is larger than the clearance.
